Terms & Conditions

1. Purpose
These General Terms and Conditions of Sale (hereinafter referred to as the “Terms”) define the rights and obligations applicable to the private concierge services, property management and seasonal rental management services provided by La Conciergerie Pirotte, a company registered under SIRET number 893 590 356 00018, with its registered office at 452 Quai des Entreprises, 84660 Maubec, and a share capital of €100,000.
2. Services
La Conciergerie Pirotte provides private individuals and professional clients with the following services:
– Property management and maintenance: supervision of all indoor and outdoor facilities, administrative support, coordination of service providers, project follow-up, welcoming on-site contractors, 24/7 concierge on-call service for requests, and monitoring of the proper delivery of services.
– Seasonal rental management: communication with tenants, personalised welcome, assistance throughout the stay, supervision of service providers (cleaning, laundry, pool, gardening, etc.), complaint handling and detailed reporting to the property owner.
3. Term and Termination
The services are provided under an open-ended contract and may be terminated at any time by written notice (email with read receipt or registered letter).
Termination shall take effect at the end of the month following receipt of the notice. Any month already commenced shall remain payable.
4. Fees and Invoicing
All fees are stated exclusive of VAT, with VAT applied at the prevailing rate (20%).
Services are invoiced monthly in arrears and are payable upon receipt of the invoice, without discount or rebate. Payment may be made by bank transfer, cheque or cash.
In the event of late payment, penalties equal to three times the statutory interest rate shall apply, together with a fixed recovery fee of €40.
La Conciergerie Pirotte reserves the right to suspend its services without prior notice in the event of non-payment.
5. Liability
La Conciergerie Pirotte is bound by an obligation of means, not of result. It undertakes to use all reasonable efforts to ensure the proper performance of the services.
Its liability is limited to direct material damage resulting from a proven fault, to the exclusion of any indirect, intangible or consequential damage (loss of income, reputational harm, etc.).
The liability cap shall not exceed the amount of fees invoiced for the month concerned.
La Conciergerie Pirotte shall not be held liable for:
– damage caused by third parties, service providers or suppliers;
– delays or failures attributable to such parties;
– pre-existing defects or faults affecting the property;
– consequences of force majeure (strikes, adverse weather, incidents, IT failures, administrative decisions, etc.).
6. Client Obligations
The Client undertakes to:
– ensure access to the property and disclose any known risks;
– comply with all legal and tax obligations relating to the property, in particular those applicable to seasonal rentals;
– take out and maintain a comprehensive home insurance policy covering, in particular, civil liability, direct and indirect damage, as well as rental risks;
– provide, upon request, a valid annual insurance certificate.
7. Confidentiality
La Conciergerie Pirotte and the Client undertake to maintain the confidentiality of all information exchanged in connection with the services (commercial, technical, financial or personal), regardless of its form.
This obligation shall remain in force for five (5) years following termination of the contract.
8. Personal Data
Personal data collected by La Conciergerie Pirotte is processed solely for the management of services and client relations, in accordance with the General Data Protection Regulation (GDPR).
The Client has the right to access, rectify and delete their data by writing to: contact@laconciergeriepirotte.com.
9. Governing Law and Disputes
These Terms and Conditions of Sale are governed by French law. Any dispute relating to their interpretation or performance shall fall under the exclusive jurisdiction of the courts of Avignon, unless otherwise required by mandatory legal provisions.
